• The Baby Contest is coming back in 2024.

• The contest is open to all residents of Canada. 

• Your baby must be between 0 and 1 year old. 

• Each month, the entries from the previous month will be subject to a public vote.

• Voting is free but is limited to 1 vote per person. The voting system resets every 24 hours.

• Voting remains open until the last day of the month.

• The monthly winner will receive $100.

• He/she will also be automatically selected to participate in the final for the baby of the year.

• At the end of the year, all the finalists will be subject to a grand final vote.

• This vote will also be open to the public.

• Voting will be open from January 8 to March 31, 2025 only.

• Once the voting period has ended, the baby with the most votes will be crowned the Baby of the Year.

• And will take home the jackpot prize of $1000!

Article 1 - Purpose
 
Noubaby Inc. is organizing a contest * (hereinafter the “contest”), from 08/01/2024 to 31/12/2025 at 11:59 p.m. via the website www.thebabycontest.ca.
All entries must be received by 11:59 PM on November 30, 2024 (the “Contest Closing Date”). 
The Contest Period will consist of a total of twelve (12) Monthly Contest Draw Periods (each a “Monthly Contest Draw Period”). For the purposes of this Contest, a "month" is defined as the period beginning on the 1st business day of the calendar month at 12:01:00 p.m. (EDT) and ending on the last day of the calendar month at 11:59:59 p.m. ( EDT). The Contest computer system (the “Contest Computer”) is used to govern all computer and time-related aspects of the Contest (including the date and time the entry form was received) and is, among other things, the official device used to measure the time for the contest. 
Each monthly winner is directly qualified to participate in the annual prize. The annual competition will bring together the 12 winners of the monthly competition. From January 8, 2025 until March 31, 2025, the public will be able to vote for the baby of the year among the 12 finalists. The photo with the most votes will win the $ 1000 prize. 
 
Article 2 - Participation
 
2.1 Access to the competition
 
In order to participate in the Contest, the participant must be a legal resident of Canada and must have reached the age of majority in their jurisdiction of residence at the time of entering the Contest.
 
Only one entry per person.
 
When choosing the winners, the Organizing Company reserves the right to ask any Participant to justify these conditions. Anyone who does not meet these conditions or refuses to justify them will be excluded from the Game and will not be able, in the event of a win, to benefit from the prize. Likewise, any false declaration, an indication of identity or address will result in the immediate elimination of the Participant.
Participation in the Game implies full acceptance of these rules.
 
Employees, representatives, agents, officers and directors (including members of their immediate families and any other person living in the same household as this person, whether they have family ties or not) of Noubaby Inc. ( the "Sponsor"), its affiliates (including, but not limited to its parent companies, sisters or subsidiaries), any advertising and promotional agencies and any suppliers of materials or services related to the Contest are not eligible to participate in the competition or to receive a prize. In the case of these official rules, "immediate family member" means the father, mother, sister, brother, son, daughter and husband or wife, including the spouse of done, regardless of the address where they reside. Groups, clubs, organizations, businesses and commercial or non-commercial entities cannot participate.
 
2.2. How to participate
 
Noubaby Inc. will publish the contest on the website www.thebabycontest.ca dedicated exclusively to the contest. 
Visit the site and click on the contest button. Complete the online entry form with your first name, last name, full email address, primary phone number, city of residence, baby's name and date of birth. Finally submit your baby's photo. 
 
Indicate that you have read, understood and accepted the official rules by checking the box provided for this purpose. Select the “Send” icon. When your photo has been received, you will receive a “thank you” email. 
 
Entries received during the month will go through an approval process by the contest organizing staff and published on the contest website the following month.
The photos will then be put to the public vote. Voting will be open from the 1st calendar day to the last calendar day of the month. The baby photo with the most votes in a given calendar month will win the monthly prize.
 
Each monthly winner is directly qualified to participate in the annual prize. The annual competition will bring together the 11 winners of the monthly competition. From January 8, 2025 until March 31, 2025, the public will be able to vote for the baby of the year among the 3 finalists. The photo with the most votes will win the $ 1000 prize.
 
Participation in the competition is made exclusively on the website www.thebabycontest.ca . 
As such, any registration by telephone, fax, post or e-mail cannot be taken into account. Participation in the game implies full and complete acceptance of these regulations, in all their provisions, of the rules of ethics in force on the Internet, as well as of the laws and regulations applicable to free games. 
Any participation that is incomplete, inaccurate or does not comply with the conditions above cannot be taken into account and will consequently result in the participation being null and void.

Vote
Voting is limited to one vote every 24 hours. Our voting system keeps the history of each vote and our technical team is able to identify illegitimate votes. If an illegitimate vote is identified, then it will be removed.
This is a photo contest for babies aiming to provide an entertaining activity for families. Please stay in the spirit of the contest.
 
Article 3 —Copyright certificate
 
Each participant certifies that he is the author and the sole owner of the copyright of the photographs presented and releases Noubaby Inc. and its representatives from any legal action that may be brought following the exhibition or publication of the photos. The author grants a non-exclusive license to Noubaby Inc., to publish, display, reproduce or modify User Generated Content. The author also waives the moral rights attached to user-generated content. 
 
Article 4 - Endowments
 
A total of  (62) prizes (individually or collectively the “Prize” (s)) will be available to be won during the Contest Period, of which one (4) will be awarded during each Monthly Contest Period. The number of prizes available will decrease as prizes are awarded. Limit of three (3) prizes per person and per household during the Contest Period.
 
Each prize will consist of $ 100 CDN which will be awarded to the winner with the most votes during the month. 
The final prize for the baby of the year is CDN $ 1000. Each winner of the monthly competition is directly qualified to participate in the annual competition.

Prize ​​REEE CST: total of one (1) RESP CST prize offered to the annual winner including:
One (1) payment of $1,000 to be deposited into the annual Beneficiary's Canadian Scholarship Trust Plan (“CST RESP”) for the benefit of the named child. The RESP CST prize will only be awarded if the annual winner agrees to provide the children's social insurance number within one year of opening the RESP CST account. The annual winner will have to work with a CST Savings inc. sales representative to set up a CST RESP for the named child if such an account does not already exist. There is no need to add or deposit any other monies or funds to the CST RESP account.

The Annual Winner must agree to the terms and conditions of the applicable CST RESP as set forth in the current CST Education Savings Plan Prospectus and Agreement. A copy of the prospectus may be obtained from CST by sending a written request to CST Savings Inc., 1600-2235 Sheppard Avenue East, Atria 2 Toronto, Ontario M2J 5B8 or by calling 1-877-333-7377.
 
The CST RESP Prize must be accepted as awarded, with no substitutions, whether in cash or otherwise. The CST RESP Prize will only be awarded to a verified winner in Canada who is a legal resident of Canada. The Annual Winner is solely responsible for paying all applicable taxes and reporting any taxable income associated with the CST RESP Prize. The Prize cannot be transferred to a third party. Any additional charges not described here are the sole responsibility of the annual winner.

The winner agrees to accept the prizes as offered, without the possibility of exchanging them, in particular for cash or other goods or services of any kind.
The Organizing Company reserves the right to replace any prize with another equivalent prize in terms of its value and characteristics, for any reason whatsoever without its liability being incurred in this regard.
 
Article 5 - Allocation of endowments
 
The winner will be contacted within 7 days of the end of the contest by email by Noubaby Inc., in order to obtain their full contact details (last name, first name, full address, telephone, e-mail) which are essential for the award of the prize. endowment.
The lot will be sent within two weeks by bank transfer.
If the winner does not appear within 7 days after the announcement of the results, the latter will be considered as having given up his prize and the photo in 2nd position will be considered the winner. 
The winner will have to comply with the rules. If it turns out that the winner does not meet the criteria of these rules, their prize will not be awarded.
The prize cannot give rise to any dispute or claim of any kind. The winner undertakes not to seek the responsibility of the Organizing company with regard to the endowment.
The prize will be accepted as advertised. No change of any kind whatsoever may be requested by the winner, for any reason whatsoever. No consideration, compensation or financial equivalent of the prizes can then be requested, totally or partially.
It is specified that the organizing company will not provide any service or guarantee, the gains consisting only of the delivery of the prizes provided for above.
 
Article 6 - Limitation of liability
 
By entering the Contest, entrants agree to discharge and hold the Released Parties harmless for any injury, loss or damage caused by, or resulting from, participation in the Contest. Without limiting the generality of the foregoing, the Released Parties will not be held responsible (a) for any incomplete or inaccurate information, caused by, or coming from contest participants, users of the Contest website, or the equipment or programming related to or used in the Contest, or a technical or human error that may occur in the processing of Entries, (b) any theft, destruction or unauthorized access, or modification of Entries or the Contest website, (c) any problem, or technical failure, of networks or telephone lines, online computer systems, servers or service providers, computer hardware, software, virus or computer bug, (d) any failure of the Contest website, (e) any failure preventing the receipt of any Entry for any reason including, but not limited to, a technical problem. that, internet traffic, or any combination thereof, (f) any damage caused to the computer of an entrant or any other person, related to, or resulting from, participating in the Contest or downloading or access to material relating to the Contest, (g) printing, distribution, programming or production errors, or any other error or malfunction of any kind, (h) errors or omissions technical, graphic, typographical or editorial contained herein, (i) any person incorrectly and / or mistakenly identified as a Winner and / or (f) any combination of the foregoing. The organizing company reserves the right to take necessary measures, at its discretion, in the event of a violation of its system or if deemed necessary for any other reason whatsoever.
 
Article 7 - Access and interpretation of the rules, modifications
 
7.1 Access

No oral request regarding the competition will be answered. 
Any complaint must be addressed in writing to the Organizing Company before 12/31/2024.
 
7.2 Interpretation of the regulations
Any question of application or interpretation of the rules, or any unforeseen question that may arise, will be decided sovereignly by the organizing company.
 
7.3 Modifications
Noubaby Inc. reserves the right to extend, shorten, modify or cancel the contest at any time, and in particular in the event of force majeure, without any compensation being claimed by the participants.
Any modification will be the subject of an amendment posted on the website.
 
Article 8 - Applicable law and jurisdiction
 
The Contest is subject to applicable federal, provincial and municipal laws and regulations. Subject to the limitations provided for by any applicable law, issues and questions relating to the construction, validity, interpretation or enforceability of the By-laws or the rights and obligations of participants, Noubaby Inc. or the other Released Parties will be interpreted and governed exclusively by the laws of the province of Quebec and the federal laws of Canada applicable herein, without regard to the rules or provisions of choice of laws or conflict of laws that may result in the application of the laws of any other jurisdiction. 
Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling.  Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

By registering with www.thebabycontest.ca, you explicitly agree that the information you provide will be governed by the www.thebabycontest.ca Privacy Policy and acknowledge that your personal information may be shared with its partners, affiliates and/or advertisers for the reasons mentioned therein, including CST savings Inc. You also give your explicit consent to www.thebabycontest.ca’s partners and/or affiliates to contact you by mail, telephone or email for the purpose of the partnership or obtaining additional information for purposes related thereto in compliance with Canada’s Anti-Spam Legislation and even in the event you have registered on the National Do Not Call List (DNCL).
